Tract 1: Legal Description: The West Half of the Southeast Quarter (W/2SE/4), The Southwest Quarter of the Northeast Quarter and that portion of the Southwest Quarter (SW/4) and the Southeast Quarter of the Northwest Quarter lying East of Highway 183 all in Section Twelve (12) Township Seven (7) South Range Eighteen (18) West of the 6th P.M., Rooks County, Kansas being approx.. 170 Acres More or Less.

General Description: This tract of land is all grass consisting of expired CRP and native grass and has been well managed. Water is supplied by the city of Stockton and there is also a pond. The fences are excellent to very good and there is a rock pit that could provide extra income.

Tract 2: Legal Description: The Southeast Quarter (SE/4) and the South Half of Northeast Quarter (S/2 NE/4) of Section Eleven (11), All that portion of the Southwest Quarter (SW/4) and the Southeast Quarter of the Northwest Quarter lying East of Highway 183 all in Section Twelve (12), The North Half of the Northwest Quarter (N/2 NW/4) of Section Thirteen (13), The North Half of the Northeast Quarter (N/2 NE/4) of Section Fourteen (14) and all of Division L lying west of Highway 183, Mickey’s Addition to the City of Stockton all in Township Seven (7) Range Eighteen (18), Rooks County, Kansas being 548 acres more or less.

General Description: This tract of land contains 172 acres of cropland with approx. 40 acres alfalfa and the balance being open. The pasture is native grass and has been well managed and there is also expired CRP suitable for haying. Water is supplied by a well located by the farmstead and there is also a pond. The fences are good although there is approximately a ½ mi. stretch at the north end where there is no fence. The buyer(s) will need to work with the adjoining land owner to determine how to address the situation. There is a rock pit that could provide extra income.

Tract 2A: Combination of Tracts 1 & 2. To combine these tracts the minimum bid will require a $10,000.00 increase above the combined offers of those two tracts.

Tract 3: Legal Description: The West Half of the Northwest Quarter (W/2 NW/4) and the Southwest Quarter (SW/4) of Section Two (2), Township Seven (7) South, Range Eighteen (18) West of the 6th P.M., Rooks County except two tracts on being 2.5 acres recorded in book 18, page 92 and a 17.7 acre tract recorded in Book 220, Page 541. Leaving a total 209.95 acres.

General Description: This tract of land has approx. 115 acres of pasture land and 95 acres of cropland. The cropland is well improved with terraces and the primary soil types a Holdrege and Uly Silt Loam. The pasture is native grasses and, at present there is no developed water on said property. The cropland is currently planted to wheat and said wheat crop is the property of the tenant.(Note; there is a rural water line across the South end of this property but it will be the Buyer(s) responsibility to request service, if wanted, and would be subject to the water district’s approval)

Minerals: All minerals not included in the producing oil lease will convey with the property on all tracts. If tracts 1 & 2 should sell as a unit then the producing royalty and overriding interest shall convey with the property. In the event that tracts 1 & 2 should sell separately then the said producing royalty and overriding interest shall be sold as a separate unit at this auction. All minerals are believed to be intact. The producing lease includes the Southwest Quarter and the West Half of the Southeast Quarter (SW/4 W/2SE/4) of Section Twelve (12), Township Seven (7) South, Range Eighteen (18) West of the 6th P.M., Rooks County, Ks. with royalty interest being .125 and the overriding interest being .05468750. This lease produced 948 bbls of oil in 2015.

Tract 4: All of Block 23, Woods Addition to the City of Stockton, Rooks County, Kansas, together with the East Half of Vacated Spruce Street and the South Half of Vacated Tenth Street adjoining thereof.

General Description: 13,300 plus sq. ft. shop building with retail and office Area. This building is divided into 5 distinct work areas and provides a host of possibilities for a purchaser and it comes with a full city block of property

FSA Info: Tracts 1 & 2 combined: Total of 718.93 acres with 251.73 being cropland. There is approx. 120.5 acres of open cropland, 52.3 acres of bottom land planted to alfalfa and the balance being retired CRP with some being suitable for haying. There is 117.50 acre wheat base w/27bu. PLC yield and an 89 acre grain sorghum base w/50 bu. PLC yield – Tract 3 – Total of 209.95 acres with 94.72 acres being cultivation with the balance being pasture & waste. There is a 39.8 acre wheat base w/37 bu. PLC yield, a 47 acre grain sorghum base w/87 PLC yield, a 1.7          acre soybean base w/18 bu. PLC yield and a .6 acre barley base with a 41 bu. yield.

Taxes: Sellers to pay all the 2016 taxes with the purchasers to pay all the 2017 and subsequent year’s taxes. 2015 taxes were; Tracts 1 & 2 combined were $2,316.14 and Tract 3 was $803.38. Tract 4 is unknown and needs to be divided out from adjoining property

Possession: Possession of Tracts 1, 2 and 4 will be immediate upon closing. Current tenant on tracts 1 & 2 has been granted until December 30, 2016 to remove personal property items including 150 +/- hay bales, cattle panels, mineral feeders, 1 creep feeder and shed. Possession of Tract 3 will be Dec. 1, 2016 on the pasture land and immediately following the 2017 wheat harvest on the cropland.

Title Insurance: Title insurance shall be used to prove clear & merchantable title with the Buyer & Seller sharing equally the owner’s policy expense. The mortgage policy, if required, will be the expense of the buyer.

Terms: Ten Percent (10%) down day of sale balance due upon closing. This auction sale is not contingent upon the purchaser's ability to finance the purchase. Buyers must make finance arrangements, if needed, prior to the auction.
