MANNER OF SALE:  This real estate will be offered in 4 individual tracts only.  THERE WILL BE NO COMBINATION OF ANY TRACTS. Auction procedure and increments of bidding are at the discretion of the auction company.

TERMS:  10% down day of sale, with the balance to be paid on or before August 30, 2022, or upon such terms as may be acceptable to the Seller.  Personal and corporate checks are acceptable for the down payment with the final payment to be made in certified funds. All funds will be held by an identified title/escrow company.  Bidding is not contingent upon financing.  Financing, if necessary, needs to be arranged and approved prior to the auction. Announcements made day of sale take precedence over printed material and previously made oral statements.

CROPS:  Seller will retain the landlord’s share of the 2022 wheat crop and the Buyer will receive the landlord’s share of any 2022 Spring or Fall planted crops.

FSA INFORMATION:   Any future FSA payments will follow the crops and will be paid pursuant to FSA regulations. 

MINERAL RIGHTS:  

    Tracts 1 & 4:  All of the Seller’s interest will transfer to the Buyers at closing.

    Tracts 2 & 3: The Seller will retain all of the oil, gas and other minerals for a period of  

                           one year and thereafter as long as production from the property is being

                           developed or operated for the production of oil and/or gas.      

CLOSING:   Date of closing will be on or before August 30, 2022.   

POSSESSION:  

·        After harvest on wheat acres.

·        After fall harvest on any 2022 Spring planted crops.

·        After the 2022 grazing season on the grassland acres.

·        Date of closing on any open acres.

 TAXES:  Taxes for 2022 will be prorated to the date of closing.
