LOCATION:  See map for directions.  SIGNS WILL BE POSTED!

MANNER OF SALE:  This real estate will be offered in 7 individual tracts only.  THERE WILL BE NO COMBINATION OF ANY TRACTS. Auction procedure and increments of bidding are at the discretion of the auction company.

TERMS:  10% down day of sale, with the balance to be paid on or before September 27, 2022, or upon such terms as may be acceptable to the Seller.  Personal and corporate checks are acceptable for the down payment with the final payment to be made in certified funds. All funds will be held by an identified title/escrow company.  Bidding is not contingent upon financing. Financing, if necessary, needs to be arranged and approved prior to the auction. Announcements made day of sale take precedence over printed material and previously made oral statements.

CROPS:  The Buyers will receive the landlord’s 1/3rd share of corn, milo and cane crops. 

FSA INFORMATION:  Any future FSA payments will follow the crops and will be paid pursuant to FSA regulations. See chart on auction bill for FSA cropland acres, base acres and yields.

MINERAL RIGHTS: 

·        Tracts 1, 2, 3 & 4:  All of the Seller’s interest will transfer to the Buyers at closing.

·        Tracts 5, 6 & 7:  Seller will retain 100% of the mineral rights for 10 years or as long as production, if any, exists.

CLOSING:  Date of closing will be on or before September 27, 2022.

POSSESSION: 

·        Date of closing on any open cropland and grassland acres.

·        After the Fall harvest or December 1, 2022, whichever date occurs first, on the corn, milo and cane crops.

TAXES:  Taxes for 2022 will be prorated to the date of closing. See chart on auction bill for 2021 tax amounts.
