MANNER OF SALE:  This real estate will be offered in 6 individual tracts only.  THERE WILL BE NO COMBINATION OF ANY TRACTS.  Auction procedure and increments of bidding are at the discretion of the auction company.

TERMS: 10% down day of sale, with the balance to be paid on or before December 1, 2022, or upon such terms as may be acceptable to the Sellers. Personal and corporate checks are acceptable for the down payment with the final payment to be made in certified funds. All funds will be held by an identified title/escrow company.  Bidding is not contingent upon financing.  Financing, if necessary, needs to be arranged and approved prior to the auction.  Announcements made day of sale take precedence over all printed material and previously made oral statements.

CROPS:

·        TRACT 1: No growing crops.

·        TRACTS 2 & 3:  Seller will retain the landlord’s share of the           

 2022 corn crop.

·        TRACTS 4 & 5:  Buyers will receive landlords’ 25% share of  

 the 2023 wheat crop.  Seller will retain the 2022 corn and  

 cane crops.

·        TRACT 6:  Buyer will receive the 2023 cash lease rent payment. Tenant will retain 100% of the 2023 wheat crop to be planted this Fall. 

FSA INFORMATION:  Any future FSA payments will follow the crops and will be paid pursuant to FSA regulations.  See chart on back for FSA cropland acres, base acres and yields.

CRP INFORMATION:  Buyers will receive the 2023 and future payments.  See chart on back for contract details.

MINERAL RIGHTS: 

·        TRACTS 1, 2, 3 & 6:  All of the Sellers’ interest will transfer to the Buyers at closing.

·        TRACTS 4 & 5:  Seller will reserve 50% of the mineral rights for a term of 5 years oras long as production, if any, exists.

CLOSING: Closing will be on or before December 1, 2022.

POSSESSION:

·        TRACTS 1, 2, 3, 4 & 5:  Date of closing, subject to tenants’ rights.

·        TRACT 6:  Date of closing on the grassland acres.  After the 2023 wheat harvest,

 or Aug. 1, 2023, whichever date occurs first, on the acres to be planted to wheat this Fall.

TAXES:  Taxes for 2022 will be prorated to the date of closing.   See chart on the back for 2021 tax amounts.
