LAND LOCATION:  See map for tract locations.  SIGNS WILL BE POSTED!!

MANNER OF SALE:  This real estate will be offered in 10 individual tracts.  THERE WILL BE NO COMBINATION OF ANY TRACTS.  Auction procedure and increments of bidding are at the discretion of the auction company.

TERMS: 10% down day of sale, with the balance to be paid on or before October 4, 2022, or upon such terms as may be acceptable to the Seller.  Personal and corporate checks are acceptable for the down payment with the final payment to be made in certified funds. All funds will be held by an identified title/escrow company in their trust account.  Bidding is not contingent upon financing.  Financing, if necessary, needs to be arranged and approved prior to the auction. Announcements made day of sale take precedence over printed material and previously made oral statements.

MINERAL RIGHTS:  All of the Seller’s interest will transfer to the Buyers at closing. 

WIND RIGHTS:  Seller will retain 50% of any future wind lease payments perpetually.

CROPS:  Seller will retain 100% of the 2022 milo crop planted on Tract 1.  There are no growing crops on Tracts 2 thru 10.

CRP PAYMENTS: Seller will retain 100% of the 2022 payments which will accrue from Oct. 1, 2021, thru Sept. 30, 2022, and the Buyer will receive all future CRP payments.

FSA INFORMATION: Any future FSA payments will follow the crops and will be paid pursuant to FSA regulations.  See sale bill for FSA cropland acres, base acres and yields.

CLOSING:  Closing will be on or before October 4, 2022.

POSSESSION:  Date of closing on the open acres with Buyer having the right to enter upon full execution of the contract and payment of the earnest money for general farming purposes; and date of closing on the CRP acres.

REAL ESTATE TAXES:  2022 taxes will be prorated to the date of closing.  See sale bill for 2021 tax amounts.
