MANNER OF SALE:  This real estate will be offered in 6 individual tracts.  THERE WILL BE NO COMBINATION OF ANY TRACTS. Auction procedure and increments of bidding are at the discretion of the auction company.

TERMS:  10% down day of sale, with the balance to be paid on or before April 12, 2024, or upon such terms as may be acceptable to the Sellers.  Personal and corporate checks are acceptable for the down payment with the final payment to be made in certified funds. All funds will be held by an identified title/escrow company.  Bidding is not contingent upon financing.  Financing, if necessary, needs to be arranged and approved prior to the auction.  Announcements made day of sale take precedence over printed material and previously made oral statements.

CROPS: Buyers will receive the landlord’s 1/3rd share of the dryland and 25% share of the irrigated wheat crops, and will reimburse the Sellers for the landlord’s share of any fertilizer expense on the dryland crop.

FSA INFORMATION:  Any future FSA payments will follow the crops and will be paid pursuant to FSA regulations. See chart below for FSA cropland acres, base acres and yields, and CRP acres.

CRP:  There are 13.23 acres enrolled in CRP on Tract 1 at $53.49/ac through 9/30/38. Total annual payment is $708 and the 2024 payment will be prorated to the date of closing.

MINERAL RIGHTS:  All of the Sellers’ interest will transfer to the Buyers at closing.

CLOSING: On or before April 12, 2024.

POSSESSION:  Date of closing on the alfalfa, open cropland and grassland acres, and after harvest on the acres planted to wheat.

SURVEY: If  Tracts 1, 2 and 3 sell to different Buyers, Sellers will provide a survey prior to closing to establish the legal descriptions.

REAL ESTATE TAXES:   Taxes for 2023 will be paid by the Sellers. Taxes for 2024 will be paid by the Buyers. See chart below for 2023 tax amounts.
